Preorder and Backorder Terms and Conditions

1. General

These Preorder and Backorder Terms and Conditions (Preorder and Backorder Terms) govern the submission of a Preorder and/or a Backorder (both defined below) with ASICS for an ASICS product. By submitting your Preorder or Backorder, you agree to be legally bound by these Preorder and Backorder Terms. These Preorder and Backorder Terms do not replace the ASICS.COM Terms of Sale that are available on this page but add to those terms. If there is any inconsistency between the ASICS.COM Terms of Sale and these Preorder and Backorder Terms, these Preorder and Backorder Terms will prevail to the extent of any inconsistency. Capitalised terms which are not defined in these Preorder and Backorder Terms have the meanings given in the ASICS.COM Terms of Sale, unless the context specifies otherwise.

These Preorder and Backorder Terms may be amended by us from time to time. While we will use reasonable endeavours to notify you of any changes to these Preorder and Backorder Terms, it is your responsibility to regularly check these Preorder and Backorder Terms for any changes made prior to submitting your Preorder and/or Backorder. Submitting a Preorder or Backorder following the posting by us of any updated version of these Preorder and Backorder Terms confirms your acceptance of the then current Preorder and Backorder Terms.

2. About Preorders and Backorders

ASICS offers Preorders and Backorders on select products. A ‘Preorder’ is for a product that has not yet been released and is not currently available, but is likely to be available in the near future. A ‘Backorder’ is for a product that is not currently available due to lack of stock. If a product is available for Preorder, a badge will be included on the product webpage indicating that the product is available for Preorder. If the product does not have a Preorder badge, it is not currently available for Preorder. For a Preorder product, the estimated shipping date will display on the product page once a size and colour are selected. If a product is out of stock, but available for Backorder, the estimated shipping date will display on the product page once a size and colour are selected.

3. No Obligation to Purchase or Sell

Each Preorder or Backorder submitted by you is a request for a future Online Purchase. Until the Preordered or Backordered product is ready for shipment, you are under no obligation to purchase, and ASICS is under no obligation to sell you, that product. These Preorder and Backorder Terms and/or your submission of a Preorder or Backorder do not constitute a binding agreement for the sale of that product to you by ASICS. Your

Preorder or Backorder and/or any acknowledgements provided by ASICS relating to your Preorder or Backorder prior to shipment is not:

(i) an acceptance of such Preorder or Backorder by ASICS;

(ii) a binding contract on the part of you or ASICS; or

(iii) a representation regarding, or confirmation of, the purchase, sale, delivery date or availability of the product. Final confirmation of your Online Purchase will be issued when your Preorder or Backorder has been fulfilled and shipped by ASICS. ASICS may decline or cancel any Preorder or Backorder at any time prior to it being ready to ship (in its sole discretion). If your Preorder or Backorder is declined or cancelled by ASICS for any reason, you will be notified at the contact information you provided, and your Preorder and/or Backorder payment, if any, will be promptly refunded in full. You may cancel any Preorder or Backorder in accordance with clause 7 below.

4. Preorder and Backorder Eligibility; Personal Use; No Resale

You may only submit a Preorder or Backorder if you are a resident of Australia. ASICS reserves the right to refuse any Preorder or Backorder not originating from Australia or any Preorders or Backorders submitted by Australian credit card holders that are suspected to be made in a fraudulent manner.

When placing a Preorder or a Backorder, you agree that you:

(i) are Preordering or Backordering Product solely for your personal, domestic or household use;

(ii) will not purchase a quantity of Product greater than is generally purchased by an individual for personal, domestic or household use; and

(iii) will not resell the Product(s) to any third party, including, but not limited to, through any third-party reseller platforms.

5. Preorder and Backorder Registration

When submitting a Preorder or Backorder, you confirm that all information you provide is complete and accurate. You must promptly notify or update us if any of your information is incorrect or changes from time to time by contacting us here. The collection, use, disclosure and handling of your personal information in connection with any Preorder or Backorder is governed by our Privacy Policy. ASICS will provide an estimated shipping date for the Preordered or Backordered product when you submit your Preorder or Backorder. ASICS will use reasonable endeavours to update you if the estimated shipping date changes. If you have any questions regarding the anticipated shipping date, please contact us here.

You will be sent a confirmation to the email address you provided when your Preordered or Backordered product has been shipped. Any Online Purchase shipped to you is subject to the ASICS.COM Terms of Sale, including our Returns Policy.

6. Payment

You will be requested to provide billing and payment information and method in connection with your Preorder or Backorder. You agree and consent to ASICS maintaining such billing and payment information and charging you using the method provided by you for the Preordered or Backordered product once that product is ready for shipment. If you select PayPal or a gift card as your payment method, you acknowledge and agree that you will be charged via that relevant payment method at the time of submitting your Preorder or Backorder, rather than once that product is ready for shipment (as is the case for other payment methods). 

7. Cancellation

You may cancel your Preorder or Backorder at any time prior to it being ready to ship by:

(i) cancelling the line item within your order history in your ASICS member account;

(ii) cancelling via the ASICS order search webpage; or

(iii) contacting us here. 

If you cancel your Preorder or Backorder at any time prior to it being ready to ship, your Preorder and/or Backorder payment, if any, will be refunded to you in full.
