Weet-Bix Kids TRYathlon Back-To-School Promotion

The Promotion starts at 12:00am AEDST on 16/1/2017 and ends 11.59pm AEDST on 23/1/2017 or until all 25 gifts have been redeemed. Promotion is valid to the first 25 customers to purchase a pair of ASICS 'kids shoes' on the ASICS website (asics.com/au/en-au) will receive a 'gift' with purchase. ‘Gifts’ are limited to one per transaction. The 'gift' is two (2) free entries to the Weet-Bix Kids TRYathlon Series, valued at $128 RRP. Entries cannot be used at the Sydney event on the 29/1/17. The entries cannot be used at any event once it had sold out or entries have closed. Eligible events include: Central Coast 5/2/17, Canberra 12/2/17, Bendigo 26/2/17, Melbourne 12/2/17, Perth 9/4/17, Adelaide 23/4/17, Gold Coast 7/5/17, Brisbane 21/5/17, Townsville 28/5/17. Entry Procedure Minor Prize Draw
To enter the Minor Prize Draw, Eligible Entrants must, during the Promotion Period:
(a) attend a day of one of the Cricket Matches;
(b) be wearing, waving or showing their Applicable ASICS Shirt at the time and location of the Minor Prize winner selection; and
(c) be the fan randomly selected by the Promoter (or its representative) when the venue big screen camera pans the crowd for fans wearing an Applicable ASICS Shirt.

Prize Restrictions/Exclusions (if any) The Minor Prize Draw will not be held on Days 4 or 5 of the Commonwealth Bank Test Matches. The International cricket fixture is subject to change (including due to bad weather) without notice. The Promoter does not accept responsibility for the cancellation or delay of any cricket match connected with this Promotion for any reason beyond its control. By entering, each winner and their parent/guardian/companion agrees to comply with the conditions attaching to the tickets won in conjunction with the promotion. Each winner and their companion also agrees to comply and ensure that all ticket holders comply with:
• any conditions or terms of ticket purchase, entry to a venue and/or attendance at a match, a copy of which will be provided to the Major Prize winner; and
• any conditions of entry imposed by the venue operator.
The Major Prize and Minor Prizes are not transferable or exchangeable. If a prize or any part of a prize is unavailable the Promoter in its discretion, reserves the right to substitute the prize (or that part of the prize) with an alternative prize to the equal value, unless to do so would be prohibited by law.
Notification and Publication of Winners Minor Prize:
The Minor Prize winner selection will be made when the Promoter’s representative scans the crowd and settles on the final entrant wearing, waving or showing an Applicable ASICS Shirt during a Cricket Match (including once per day of Days 1-3 of a Commonwealth Bank Test Cricket Match).
Minor Prize winners will be notified by public announcement immediately, and by email in writing within 2 business days of being selected as the Minor Prize winner.
It is the responsibility of the Eligible Entrant to ensure that his/her contact details are correct and to notify the Promoter of any changes to the contact details (and to obtain consent from their parent or guardian if the Eligible Entrant is under 18 years of age). The Promoter will not be liable if it cannot contact any Minor Prize winner because of any incorrect contact details provided to it by an entrant.
Major Prize:
The Major Prize winner will be notified by telephone and email within 1 business days of being selected. The Major Prize winner’s name will be published on the Promoter’s website at www.asics.com.au/competitions on 23 January 2017.

All costs associated with a travel prize which are not expressly stated in the Prize Details to be included, including additional spending money, passport and visa costs, transfer and transit costs, meals, taxes, insurance, luggage costs and all other ancillary costs, are the responsibility of the winner. The winner and any travelling companion(s) must depart and return at the same time using the same air carrier.   1. These terms and the Schedule form the Conditions of Entry for this Promotion, and set out all of the information you need to know regarding this Promotion. Capitalised terms have the meaning given in the Schedule, unless otherwise stated. If there’s any inconsistency between these terms and the Schedule, then what’s in the Schedule is correct. By submitting your entry, you agree that these Conditions of Entry apply to your entry.
  2. The promoter is ASICS Oceania (ABN 59 003 091 389), of 10 Interchange Dr, Eastern Creek NSW 2766 (‘Promoter’, ‘we’, ‘us’).
  3. Any updates to these Conditions of Entry will be subject to regulatory approval, and will be published on our website www.asics.com.
  4. au/competitions, so it’s important to check these Conditions of Entry regularly.

    Who can enter … and who can’t

  5. The eligibility requirements for this Promotion are set out in the Entry Restrictions. Directors, managers, employees, officers, agents and contractors of the Promoter, and their immediate families (ie spouse, partner, parent, grandparent, natural or adopted child, and sibling (whether natural or adopted by a parent)) are ineligible to enter.

  6. How to enter

  7. To enter, you must follow the Entry Procedure.
  8. We will not accept entries which are incomplete, illegible, or which are generated by computers or other automated means.
  9. Subject to State and Territory legislation, we reserve the right to disqualify your entry in the event of non-compliance with these Conditions of Entry or if, in our reasonable opinion, you tamper or interfere with an entry mechanism in any way or, act in a potentially obscene, scandalous, offensive or defamatory manner.
  10. If the Promotion cannot run for reasons beyond our control (for example, infection by computer virus, mobile network failure, bugs, tampering, unauthorised intervention, fraud, or technical failures), we reserve the right to cancel, suspend, modify or terminate the Promotion (subject to regulatory approval). If that happens, we’ll select a winner from eligible entries received at the time.
  11. All decisions made by us regarding any aspect of the Promotion are final, but are subject to State and Territory legislation, and no correspondence will be entered into.

  12. Prizes

  13. The prize(s) are set out in the Prize Details and are subject to any restrictions specified in the Prize Restrictions/Exclusions. Prize values are accurate as at the commencement date of the Promotion. Any variation after that date is beyond our control. All costs, fees, charges or expenses associated with the prize(s), which are not specified in the Schedule, are the responsibility of the winner(s).
  14. Prizes are not transferable, exchangeable or redeemable for cash. If for any reason a prize is not available, we will substitute it for another prize of equal or higher value (in our discretion), subject to regulatory approval.

  15. How winners are chosen and notified

  16. Draw Details are set out in the Schedule. We will notify winners, and publish their names, in accordance with the Notification and Publication of Winners information set out in the Schedule.

  17. How to claim prizes

  18. Prizes will be posted using the address information provided on the entry form, unless the winner provides an alternative address at the time they are notified as being a winner. If prizes are not suitable for posting, we will determine the best delivery method. Prize winners should allow up to four weeks for delivery. We accept no responsibility for any lost or misdirected mail, or any damage to prizes caused in transit.
  19. If (having made reasonable efforts) we cannot contact a prize winner, or if any prize is not accepted or claimed by the Prize Claim Date, we will conduct an Unclaimed Prize Draw (subject to any directions given by relevant gaming authorities).
  20. We will notify winners of any Unclaimed Prize Draw, and publish their names, in accordance with the Unclaimed Prize Draw details specified in the Schedule.
  21. At our request, prize winners (and their companion(s), if applicable) must sign (or ensure that their parent/guardian signs) an indemnity and exclusion of liability form provided by us. If a winner (or their parent/guardian) does not sign that form within the time specified by us, they will not be able to participate and that winner’s entry or prize claim will be declared invalid. If a winner’s entry is declared invalid prior to the Prize Claim Date, we may select a new winner in accordance with the Unclaimed Prize Draw.
  22. If you are a winner, you are responsible for your use of the prize, including complying with all relevant laws and any applicable terms and conditions of use.

  23. Promoter’s use of entries and personal information

  24. On submission, entries become the property of the Promoter. By entering this Promotion, you consent to us and Cricket Australia using your entry in any media for an unlimited period without compensation for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by us.
  25. By participating in this Promotion, you understand and agree that ASICS Oceania and Cricket Australia may use and disclose the personal information provided by you for the purpose of conducting the Promotion and for any of the purposes set out in ASICS Oceania’s Privacy Policy (available at http://www.asics.com/au/en-au/privacy-policy or by emailing asics@asics.com.au) and/or Australian Cricket’s Privacy Policy (available at www.cricket.com.au/privacy), which contains information about how you may access and seek correction of your personal information or complain about a breach of your privacy, and how ASICS Oceania and/or Cricket Australia will deal with that complaint. ASICS Oceania and Cricket Australia may also disclose your personal information to other parties, including Australian Cricket's third party service providers. From time to time, these third parties may be located (and so your personal information may be disclosed) overseas, including in India, the USA and the UK, and other countries from time to time. ASICS Oceania may use your personal information for direct marketing purposes, unless you opt out (which you can do at any time in accordance with ASICS Oceania’s and/or Cricket Australia’s Privacy Policy).   26. If requested by us or Cricket Australia, each winner must participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge. If you are a winner, you consent to us and Cricket Australia using your name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without compensation for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by us. If you are under 18 years of age, your parent or guardian must give us or Cricket Australia this consent on your behalf.

  27. General stuff (boring but important)

We and Cricket Australia accept no responsibility for any problems or technical malfunction of any communication network or for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. We have no control over telephone communications, networks or lines and accept no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. We and Cricket Australia are not liable for any consequences of user error including any costs incurred.
  29. You acknowledge that there may be inherent risks in some aspects of the Promotion or the prize and that participation in the Promotion or the prize may involve participating in dangerous activities. By entering this Promotion and/or accepting the prize, you accept that risk for yourself and for your companion(s) (if applicable).
  30. You will be responsible for any tax liability associated with a prize.
  31. To the extent permitted by law, we and Cricket Australia will not be liable for any loss or damage whatsoever (including direct or consequential loss) or personal injury suffered or sustained in connection with the prizes or this Promotion. We accept no responsibility for any tax liabilities that may arise from winning a prize.
  32. We and Cricket Australia are not responsible for use of a prize which results in:
    • (a) loss that was not reasonably foreseeable;
    • (b) loss that was not caused by the our breach of these Conditions of Entry or by our negligence;
    • (c) business losses (such as lost data, lost profits or business interruptions) or loss suffered by non-consumers;
    • (d) losses caused by factors which could reasonably be considered to be outside our control (such as faults in third party equipment); and
    • (e) any loss caused, or contributed to, by an entrant’s breach of these Conditions of Entry or an entrant’s negligence.

Terms and Conditions (Skill-Based Competition)


    General

  1. Information on how to enter and prizes form part of the Terms and Conditions. Entry into this competition deems acceptance of these Terms and Conditions.

  2. To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.

  3. Who can enter

  4. Subject to clause 4, entry is open to all residents of Australia who have fulfilled the requirements set out below ('Eligible Entrants').

  5. Employees, and their immediate families, of the Promoter, associated agencies and companies, Permitz Group Pty Ltd, contractors or individuals are not eligible to enter this competition. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or 1st cousin.

    How to enter

  8. Eligible Entrants may enter this competition during the Promotional Period by: purchasing certain ASICS footwear from the ASICS website at www.asics.com/au/en-au or at a Sydney or Melbourne Flagship Retail stores. The footwear purchase which qualifies an Eligible Entrantsto enter is from the Marathon Collection ('Eligible Product Purchase'). Other footwear purchases from other retailers or that are not part of the Marathon Collection do not qualify for entry. Eligible Entrants must complete the entry form, including an answer to the question posed and their receipt number/ online order form number, at http://www.asics.com/au/en-au/marathon-comp.

  9. Entries must include all requested contact details and a 25-words-or-less answer to be eligible to win. Each entry must be unique and received by the Promoter prior to the competition close date and time.

  10. By submitting an entry into this competition entrants consent to receive promotional and other marketing messages from the Promoter (including messages sent electronically for an unlimited period of time). Entrants will be able to opt-out at any time by following the instructions included in each message sent by the Promoter.

    When to enter

  12. The competition commences on 08/12/16 at 09:00 AM and closes 03/04/17 at 23:59 PM ('Promotional Period'). All times noted in these Terms and Conditions are local times, based on the location of the Promoter. Entries must be received by the Promoter prior to the competition close date and time.

  13. The winner will be the best valid entry as judged by the judging panel, having regard to skill, creativity and originality, at the Promoter's Premises on Apr 07, 2017 10:00 AM. The Promoter may select additional entries to be used as replacements in the event that the first entrant chosen as a winner cannot satisfy these Terms and Conditions or take a prize.

  14. The winner will be notified by email and their names will be published online at http://www.asics.com/au on Apr 07, 2017.

  15. Prizes will be sent within 8 weeks of the judging date.

    Number of Entries permitted

  17. One entry per Eligible Product Purchase. All entrants must retain their original receipts, documents or tags to validate proof of purchase during the promotional period. Such evidence must, on request by the Promoter, be provided to the reasonable satisfaction of the Promoter, to demonstrate that the entrant has complied with these Terms and Conditions. Any entrant found to be sharing any receipt or other proof to demonstrate Proof of Purchase with any other entrant, whether or not related in any way, will have all entries invalidated and will not be able to claim a prize. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any awarded prize to the Promoter. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request. The Promoter may conduct an immediate redraw if the first drawn entrant is unable to satisfy this clause.

    Prize on offer

  19. Total prize value is up to $4150 (Including GST), as at 2/12/16. The prize on offer is for one major prize winner who will receive:

    • 2 x return airfares(s) to Stockholm Sweden Marathon in June 2017;

    • 2 x free entry into the race and

    • 3 x nights' accommodation at a hotel in Stockholm

    • A running package of apparel valued at $150 (RRP)

  20. If the Promoter is unable to contact the winner to claim fulfilment of the promotional prize or if the winner is unable to attend any element of the prize, that winner will forfeit the prize in its entirety and it shall be awarded to the next runner up in the promotion. The Promoter will not be liable for a winner who cannot be contacted and therefore forfeits their prize and no correspondence will be entered into.

  21. Prize must be taken by the event date in June 2017. In the event a winner does not take the prize by the time stipulated, then the entire prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.

  22. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

  23. Unless expressly stated in these Terms and Conditions all other expenses are the responsibility of the winners (and their companions) including but not limited to current passports, visas, meals, spending money, transport to and from departure and arrival points, transfers, drinks, incidentals, mini-bar, laundry, room service, telephone calls, activities, gratuities, services charges, travel insurance, pre and post accommodation, optional activities or excursions and all other ancillary costs. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges.

  24. By entering the competition, and by collecting a prize, the winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling. It is the responsibility of the prize-winner to enquire about local issues and conditions at destinations prior to travel. The Promoter does not guarantee that the winner will enjoy the travel prize or be suited to the type of travel prize that is offered.

  25. Accommodation is twin share standard room. Prize includes flights from winner’s nearest capital city airport to Stockholm airport. Travel arrangements from the winner's home to their nearest capital city airport, and from the winner’s nearest capital city airport to the winner’s home do not form part of the prize unless expressly stated in these terms & conditions and are the responsibility of the winner and their travelling companions. Eligible Australian capital cities include Sydney, Melbourne, Brisbane, Adelaide, Darwin, Hobart, Canberra and Perth. The winner must travel on the same flights and itinerary as their travelling companions. The travel prize cannot be used as part payment for another airfare package. Frequent flyer miles cannot be accrued on this prize. Flights and accommodation are subject to availability at the time of booking and cannot be exchanged for other destinations. Travel restrictions & blackout dates apply. Prizes cannot be taken during peak periods or school holidays, and winners must provide all suppliers with a minimum of 21 days advance notice of intention to travel. Embargo restrictions apply during certain periods. Bookings are subject to conditions & availability (including but not limited to capacity limitations and other restrictions).

  26. Compliance with any health or other government requirements is the responsibility of the prize winner and their travel companions. All prize travel will be subject to the carrier's General Conditions of Carriage. The Promoter and carrier make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including local government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade at www.smartraveller.gov.au. Prizes for travel for a particular event or attraction must be taken to coincide with the event or the times and dates during which the attraction is available.

    Further Terms and Conditions

  28. The Promoter reserves the right to amend these Terms and Conditions if this competition cannot be run as originally planned. The Promoter may also cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition.

  29. The Promoter and their associated agencies and companies will not be liable or responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems of the phone or of any phone network, or any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur; whilst undertaking any travel won on or connected with their entry; in the participation in any prize; as a consequence of late, lost or misdirected mail, email SMS or phone call; due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person; any injury or damage to entrant's or any other person's computer software or phone; or any combination thereof, related to or resulting from participation or sending or receiving of any communication or of any materials in this competition.

  30. All entrants must submit ONLY their own original answers, designs and works. Any such answers, designs or works cannot be previously published in any forum worldwide. All entries become the property of the Promoter and cannot be returned. Entries that are found to have been derived from the designs of a third party will be considered invalid and, if awarded a prize, that prize must be returned to the Promoter. The winner may be required to sign a statutory declaration regarding the originality of the entry. Without limiting the generality, the Promoter reserves the right to take legal action against anyone found to have breached this term. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation are reserved.

  31. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier's requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.

  32. The Promoter highly recommends a current residential street address be provided when requested for ease of correspondence and potential prize delivery. The Promoter makes all reasonable efforts to deliver prizes to the addresses provided by competition entrants. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize winner.

  33. The Promoter reserves the right to request winners to sign a winner's deed of release or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

  34. The Promoter reserves the right to rejudge in the event of an entrant, claiming to be a winner, being unable to satisfy these Terms and Conditions.

  35. The judges' decision in relation to any aspect of the competition is final and binding on each person who enters. Chance plays no part in determining any winner. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Prizes are subject to availability, not transferable or exchangeable and, with the exception of cash prizes, cannot be taken as cash. Prizes will be sent to the winner's nominated address as stated in their original entry. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit.

The Promoter may disclose personal information collected to an agent who is engaged for prize fulfilment.     Copyright, Statutory guarantees, Waiver and liability

  40. All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received. In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners (and their companions) agree to granting the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winners (and their companions) will not be entitled to any fee for such use.

  41. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.

  42. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ('Non-Excludable Guarantees').

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a prize.
