Gold Coast Tri Facebook Promotion

1. Information on how to enter and prizes form part of these conditions of entry. Entry into the promotion is deemed acceptance of these conditions of entry.

2. The Promoter is ASICS Oceania Pty Ltd of 10 Interchange Drive Eastern Creek NSW 2766 ABN: 59 003 091 389.

3. Entry is only available to Australian Residents.

4. If entrants have not yet reached the legal age for a Facebook Account (13 years), entrants must have their parent or guardians enter on behalf of them through their Facebook Account. Entrants must have parent or guardian’s permissions to enter this promotion.

5. Employees and their immediate families of ASICS and their partners, printers, suppliers, providers and agencies associated with this promotion are ineligible.

6. The promotion commences on Monday 3/04/17 at 12:25pm (AEST) and concludes on Friday 7/04/17 at 23:59 (AEST) (Promotional Period). The promotion is an ASICS Oceania competition posted on its partner, IRONMAN, Facebook page; Multi Sport Festival (https://www.facebook.com/MultiSportTri/). The competition post will be published on the 3/04/17 at 12:25pm (AEST).

7. The Prize: There is only 1 major prize winner, there are no minor prizes. The major prize winner will receive:

  • 1 (One) x pair of ASICS footwear from the value of RRP $200. The footwear prize will be an option from the ASICS Flytefoam Trio; GEL-Noosa FF, GEL-DS Trainer, Dynaflyte.

8. All entries will be judged and selected at ASICS Oceania Pty Ltd, 10 Interchange Drive Eastern Creek NSW 2766 at 11.00 am Tuesday 11/04.17 (AEST) from all valid entries. This is a game of skill; chance plays no part in determining the winners. Entries will be judged based on creativity, originality and skill by ASICS Oceania Head Office Judges (referred hereafter as “The Judges”). The judges’ decision in relation to any aspect of the competition is final and binding on each person who enters and no correspondence will be entered into. No responsibility is accepted for late entries.

9. The winner will be notified via a comment on the promotion Facebook post as well as an Facebook direct message at 4.00pm Wednesday 12/04/17 (AEST). The promoter reserves the right to publish the Winner’s name and photo. The winner must respond within 48 hours, otherwise the winner will forfeit the prize.

10. To enter The Promotion, Eligible Entrants must, during the Promotional Period:

  1. Comment on the competition post, published on the Multi Sports Tri Facebook page (https://www.facebook.com/MultiSportTri/), and tell us in 25 words or less which pair of Flytefoam Trio shoes they would like to fly in and why.

    It is each entrant’s responsibility to adhere to the requirements of the Terms & Conditions, the prevailing terms and conditions of Facebook and the Promoter’s websites respectively and The Promoter will take no responsibility for any entry or photo that has been uploaded incorrectly.

11. Eligible Entrants may enter multiple entries during the Promotional Period.

12. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants acknowledge that they are providing their entry information to the Promoter and not to Facebook. The information so provided will only be used for the purposes of the Promotion and as detailed in these Terms and Conditions. Facebook is not responsible for providing any information regarding questions, comments or complaints regarding the Promotion. Please direct all correspondence to the Promoter. Any link or mention of Facebook is not to be taken as an endorsement or approval of their Terms of Use by the Promoter.

13. Incomplete, indecipherable, or illegible entries will be deemed invalid. The Promoter reserves the right to disqualify any entry where it reasonably suspects that such materials are prohibited by these Terms and Conditions, any relevant law, or are otherwise deemed inappropriate. This is at the Promoter's absolute discretion and discussions will not be entered into. Photos that are considered unlawful or contain objectionable content, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive, contain nudity or otherwise objectionable will not be acceptable and deemed invalid. The Promoter reserves the right to request winners to provide proof of identity. The proof must be presented by fax, email or post within 48 hours of request. Proof considered suitable for verification is at the discretion of the Promoter. Failure to provide such proof will immediately invalidate the prize winner’s entitlement to the prize, subject to state legislation.

14. Total maximum prize pool value is $220. The Prize is not transferable or exchangeable and cannot be taken as cash. A prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value. All prize values are the recommended retail price including GST.

15. Any unclaimed prize will result in The Judges judging all entrants again at ASICS Oceania Head Office on 19/04/17 at 10am (AEST). The unclaimed prize winner (if any) will be notified by Facebook comment. All reasonable steps to notify the winner (if any) of the results of the unclaimed prize will be taken by The Promoter.

16. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.

17. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any Eligible Entrant or voter; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate.

18. Any cost associated with accessing the Promotional Website is the entrant's or voter's responsibility and is dependent on the Internet service provider used.

19. The use of any automated entry software or any other mechanical or electronic means that allows an entrant or voter to automatically enter repeatedly is prohibited and will render all entries or votes submitted by that entrant or voter invalid. The Promoter reserves the right to determine this in its absolute discretion.

20. The Promoter highly recommends a current residential street address be provided when requested for ease of correspondence and potential prize delivery. The Promoter makes all reasonable efforts to deliver prizes to the addresses provided by competition entrants. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize winner.

21. The Promoter collects personal information in order to notify the winners.

22. Registration information and other information about you is subject to our Privacy Policy http://www.asics.com.au/privacy you understand that through your use of the Site you consent to the collection and use (as set forth in the Privacy Policy) of this information.

23. Unfortunately no data transmission over the Internet can be guaranteed as totally secure. Whilst we endeavour to protect such information, we do not warrant and cannot ensure the security of any information which you transmit to us. Accordingly any information which you transmit to us is transmitted at your own risk, however once we receive your transmission, we will take reasonable steps to preserve the security of such information.

24. The Terms and Conditions, and the use of the Site and any contents thereof, are in all respects governed by and according to the laws of the State of New South Wales, Australia. By using the Site, you irrevocably agree to submit to the exclusive jurisdiction of the courts of New South Wales,

Terms and Conditions (Skill-Based Competition)


    General

  1. Information on how to enter and prizes form part of the Terms and Conditions. Entry into this competition deems acceptance of these Terms and Conditions.

  2. To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.

  3. Who can enter

  4. Subject to clause 4, entry is open to all residents of Australia who have fulfilled the requirements set out below ('Eligible Entrants').

  5. Employees, and their immediate families, of the Promoter, associated agencies and companies, Permitz Group Pty Ltd, contractors or individuals are not eligible to enter this competition. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or 1st cousin.

  6. The Promoter is ASICS Oceania Pty Ltd (ABN 59 003 091 389) of 10 Interchange Drive, Eastern Creek NSW 2766 ('Promoter').

    How to enter

  8. Eligible Entrants may enter this competition during the Promotional Period by: purchasing certain ASICS footwear from the ASICS website at www.asics.com/au/en-au or at a Sydney or Melbourne Flagship Retail stores. The footwear purchase which qualifies an Eligible Entrantsto enter is from the Marathon Collection ('Eligible Product Purchase'). Other footwear purchases from other retailers or that are not part of the Marathon Collection do not qualify for entry. Eligible Entrants must complete the entry form, including an answer to the question posed and their receipt number/ online order form number, at http://www.asics.com/au/en-au/marathon-comp.

  9. Entries must include all requested contact details and a 25-words-or-less answer to be eligible to win. Each entry must be unique and received by the Promoter prior to the competition close date and time.

  10. By submitting an entry into this competition entrants consent to receive promotional and other marketing messages from the Promoter (including messages sent electronically for an unlimited period of time). Entrants will be able to opt-out at any time by following the instructions included in each message sent by the Promoter.

    When to enter

  12. The competition commences on 08/12/16 at 09:00 AM and closes 03/04/17 at 23:59 PM ('Promotional Period'). All times noted in these Terms and Conditions are local times, based on the location of the Promoter. Entries must be received by the Promoter prior to the competition close date and time.

  13. The winner will be the best valid entry as judged by the judging panel, having regard to skill, creativity and originality, at the Promoter's Premises on Apr 07, 2017 10:00 AM. The Promoter may select additional entries to be used as replacements in the event that the first entrant chosen as a winner cannot satisfy these Terms and Conditions or take a prize.

  14. The winner will be notified by email and their names will be published online at http://www.asics.com/au on Apr 13, 2017.

  15. Prizes will be sent within 8 weeks of the judging date.

    Number of Entries permitted

  17. One entry per Eligible Product Purchase. All entrants must retain their original receipts, documents or tags to validate proof of purchase during the promotional period. Such evidence must, on request by the Promoter, be provided to the reasonable satisfaction of the Promoter, to demonstrate that the entrant has complied with these Terms and Conditions. Any entrant found to be sharing any receipt or other proof to demonstrate Proof of Purchase with any other entrant, whether or not related in any way, will have all entries invalidated and will not be able to claim a prize. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any awarded prize to the Promoter. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request. The Promoter may conduct an immediate redraw if the first drawn entrant is unable to satisfy this clause.

    Prize on offer

  19. Total prize value is up to $4150 (Including GST), as at 2/12/16. The prize on offer is for one major prize winner who will receive:

    • 2 x return airfares(s) to Stockholm Sweden Marathon in June 2017;

    • 2 x free entry into the race and

    • 3 x nights' accommodation at a hotel in Stockholm

    • A running package of apparel valued at $150 (RRP)

  20. If the Promoter is unable to contact the winner to claim fulfilment of the promotional prize or if the winner is unable to attend any element of the prize, that winner will forfeit the prize in its entirety and it shall be awarded to the next runner up in the promotion. The Promoter will not be liable for a winner who cannot be contacted and therefore forfeits their prize and no correspondence will be entered into.

  21. Prize must be taken by the event date in June 2017. In the event a winner does not take the prize by the time stipulated, then the entire prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.

  22. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

  23. Unless expressly stated in these Terms and Conditions all other expenses are the responsibility of the winners (and their companions) including but not limited to current passports, visas, meals, spending money, transport to and from departure and arrival points, transfers, drinks, incidentals, mini-bar, laundry, room service, telephone calls, activities, gratuities, services charges, travel insurance, pre and post accommodation, optional activities or excursions and all other ancillary costs. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges.

  24. By entering the competition, and by collecting a prize, the winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling. It is the responsibility of the prize-winner to enquire about local issues and conditions at destinations prior to travel. The Promoter does not guarantee that the winner will enjoy the travel prize or be suited to the type of travel prize that is offered.

  25. Accommodation is twin share standard room. Prize includes flights from winner’s nearest capital city airport to Stockholm airport. Travel arrangements from the winner's home to their nearest capital city airport, and from the winner’s nearest capital city airport to the winner’s home do not form part of the prize unless expressly stated in these terms & conditions and are the responsibility of the winner and their travelling companions. Eligible Australian capital cities include Sydney, Melbourne, Brisbane, Adelaide, Darwin, Hobart, Canberra and Perth. The winner must travel on the same flights and itinerary as their travelling companions. The travel prize cannot be used as part payment for another airfare package. Frequent flyer miles cannot be accrued on this prize. Flights and accommodation are subject to availability at the time of booking and cannot be exchanged for other destinations. Travel restrictions & blackout dates apply. Prizes cannot be taken during peak periods or school holidays, and winners must provide all suppliers with a minimum of 21 days advance notice of intention to travel. Embargo restrictions apply during certain periods. Bookings are subject to conditions & availability (including but not limited to capacity limitations and other restrictions).

  26. Compliance with any health or other government requirements is the responsibility of the prize winner and their travel companions. All prize travel will be subject to the carrier's General Conditions of Carriage. The Promoter and carrier make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including local government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade at www.smartraveller.gov.au. Prizes for travel for a particular event or attraction must be taken to coincide with the event or the times and dates during which the attraction is available.

    Further Terms and Conditions

  28. The Promoter reserves the right to amend these Terms and Conditions if this competition cannot be run as originally planned. The Promoter may also cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition.

  29. The Promoter and their associated agencies and companies will not be liable or responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems of the phone or of any phone network, or any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur; whilst undertaking any travel won on or connected with their entry; in the participation in any prize; as a consequence of late, lost or misdirected mail, email SMS or phone call; due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person; any injury or damage to entrant's or any other person's computer software or phone; or any combination thereof, related to or resulting from participation or sending or receiving of any communication or of any materials in this competition.

  30. All entrants must submit ONLY their own original answers, designs and works. Any such answers, designs or works cannot be previously published in any forum worldwide. All entries become the property of the Promoter and cannot be returned. Entries that are found to have been derived from the designs of a third party will be considered invalid and, if awarded a prize, that prize must be returned to the Promoter. The winner may be required to sign a statutory declaration regarding the originality of the entry. Without limiting the generality, the Promoter reserves the right to take legal action against anyone found to have breached this term. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation are reserved.

  31. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier's requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.

Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

  34. The Promoter reserves the right to rejudge in the event of an entrant, claiming to be a winner, being unable to satisfy these Terms and Conditions.

  35. The judges' decision in relation to any aspect of the competition is final and binding on each person who enters. Chance plays no part in determining any winner. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Prizes are subject to availability, not transferable or exchangeable and, with the exception of cash prizes, cannot be taken as cash. Prizes will be sent to the winner's nominated address as stated in their original entry. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit.

The Promoter may also disclose personal information collected to Australian regulatory authorities, such as the regulators of trade promotions.     Copyright, Statutory guarantees, Waiver and liability

  40. All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received. In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners (and their companions) agree to granting the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winners (and their companions) will not be entitled to any fee for such use.

  41. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.

  42. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ('Non-Excludable Guarantees').

  43. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a prize.
